Terms & Conditions

Last updated

These are the terms on which Nomad rents vehicles and camping equipment, runs guided treks and camping trips, and sells outdoor gear. They are written to be read, not to be skimmed past — the sections on deposits, damage and where you may take a vehicle are the ones that matter most in practice.

01Who these terms are between

These terms are an agreement between you and Nomad, operating from Lake City Plaza, Karan Nagar, Srinagar 190010 (“Nomad”, “we”, “us”).

They apply whenever you book or hire anything from us — a vehicle, camping equipment, a guided trek or a camping trip — through our app, this website, WhatsApp, telephone or over the counter.

Booking with us means you accept these terms. You will also sign a rental agreement at collection covering the specific vehicle; where the two differ, the signed rental agreement takes precedence.

02Who can rent

  • You must be at least 18 years old. Larger touring motorcycles carry a higher minimum age, which we will tell you before you book
  • You must hold a valid driving licence carrying the correct class for the vehicle. An LMV car licence does not permit you to ride a motorcycle in India
  • Visitors from outside India must present an International Driving Permit together with their original national licence, plus passport and valid visa
  • Learner’s licences are not accepted under any circumstances
  • Low-speed electric bikes limited to 250 W and 25 km/h require no licence, and anyone 18 or over may hire one

We may refuse or cancel a hire if documents are missing, invalid or expired, if we reasonably believe you are unfit to ride, or if you appear to be under the influence of alcohol or drugs. In those cases the cancellation terms for a no-show apply.

03Booking and payment

A booking is confirmed when we receive your advance payment, not when you submit the request. Until then the vehicle is held only briefly and may be taken by someone else.

  • The price you are quoted at booking is the price you pay. Later rate changes do not affect a confirmed booking
  • The balance is payable at collection, by cash, UPI or card
  • A refundable security deposit is payable at collection. The amount depends on the vehicle
  • Fuel is not included unless we state otherwise in writing
  • All prices are in Indian Rupees and include applicable taxes unless stated

Online payments are processed by Cashfree Payments. We never see or store your card details. A booking is confirmed only once we receive verified confirmation from the payment provider — a message on your screen is not confirmation on its own.

04Security deposit

The deposit covers damage, loss, unpaid charges and traffic penalties incurred during your hire. It is returned when the vehicle or equipment comes back in the condition it left.

  • Cash and UPI deposits are returned the same day, at return
  • Deposits taken online are refunded to the original payment method, typically within 3 to 7 working days
  • We will not withhold any part of a deposit without photographic evidence of the damage, recorded at return with you present
  • If damage exceeds the deposit, the difference is payable by you

We do not retain your original passport, licence or identity documents as security. We photograph them and return them to you immediately.

05Your responsibilities while riding

For the duration of the hire the vehicle is in your care. You agree to:

  • Hold a valid licence for the vehicle and carry it, with photo ID, at all times
  • Wear the helmet provided. It is a legal requirement and it is enforced
  • Obey all traffic laws and posted restrictions
  • Never ride under the influence of alcohol, drugs or medication that impairs you
  • Not allow anyone else to ride the vehicle, other than a named additional rider agreed with us in writing who meets the same licence requirements
  • Not use the vehicle for racing, stunts, towing, carrying goods for hire, or any illegal purpose
  • Not exceed the vehicle’s seating capacity
  • Park securely and use the lock provided
  • Tell us immediately if the vehicle is damaged, breaks down, is stolen, or is involved in any accident

Traffic fines, tolls and penalties incurred during your hire are yours. Where a challan reaches us after you have returned the vehicle, we will send you the evidence and recover the amount.

06Vehicle condition, damage and insurance

We inspect the vehicle with you at collection and again at return, photographing its condition, odometer and fuel level on both occasions. Those photographs are the record we use to assess any damage claim, and you are entitled to a copy.

  • Normal wear is expected and never charged
  • Our vehicles carry third-party insurance as required by law. This covers injury or damage you cause to others. It does not cover damage to the vehicle itself
  • Damage to the rented vehicle is your responsibility, assessed against the return photographs
  • Insurance is void if you ride without a valid licence, under the influence, or in breach of these terms. In that case you are personally liable for the full loss
  • Loss of the vehicle, keys or documents is chargeable at replacement cost

Tell us the moment something goes wrong. We would far rather arrange a replacement or a recovery than argue about it afterwards.

07Distance, fuel and late return

ChargeHow it is calculated
Extra distanceWhere a kilometre allowance applies, distance beyond it at the published per-km rate
Late returnA full additional day after a two-hour grace period
Fuel shortfallThe difference between the fuel level at collection and at return, at the published rate
Excessive cleaningCharged only where the vehicle is returned in a state beyond ordinary road dirt

Distance is taken from the odometer readings recorded at collection and return, and may be verified against the vehicle’s GPS record.

08GPS tracking

Every vehicle we rent carries a GPS tracker, and you should assume it is active for the whole hire.

We use it to recover overdue or stolen vehicles, to verify distance, and to locate you if you break down somewhere remote — which on the roads towards Sonmarg and Zojila is a genuine safety measure rather than a formality.

We do not monitor your movements for any other purpose. Raw location points are deleted after 90 days. Full detail is in our Privacy Policy.

09Where you can take the vehicle

Vehicles may be ridden on public roads within the Kashmir valley. Taking a vehicle beyond that — including Zojila Pass and the Srinagar–Leh highway — requires our agreement in advance, and is only permitted on vehicles suited to it.

  • Do not take a vehicle onto closed roads, restricted areas, or anywhere access is prohibited
  • Do not attempt high passes in poor weather or outside the season they are open
  • Off-road riding is not permitted unless expressly agreed

Taking a vehicle outside the agreed area breaches these terms, voids the insurance and makes you liable for recovery costs.

10Camping equipment hire

Equipment is inspected with you at collection and return. You are responsible for it while it is in your care.

  • Normal wear is not charged. Tears, burns, broken poles and lost items are
  • Return equipment dry and reasonably clean where you can. We do not charge for ordinary trail dirt
  • Tell us if something fails during your trip. We will replace it where we can reach you
  • Lost or unreturned items are charged at replacement cost

11Guided treks and camping trips

  • You must be honest with us about your fitness and experience. Trekking at altitude is demanding, and misrepresenting your ability puts you and the group at risk
  • You must follow your guide’s instructions. A guide may turn a group back, alter a route or refuse to continue on grounds of weather, safety, or a participant’s condition, and that decision is final
  • We may alter or abandon an itinerary for weather, road closures, permit changes or safety. Where we do, our Cancellation & Refunds Policy sets out what you get back
  • You are responsible for your own travel and medical insurance. We strongly recommend it
  • You must declare any medical condition or medication that could matter in a remote setting

12Buying gear

Items purchased outright are sold over the counter at our Srinagar store. We do not currently sell or ship online. Unused items in original condition may be exchanged within 7 days with the receipt. For hygiene reasons, sleeping bag liners and similar items cannot be exchanged once opened. This does not affect your rights in respect of a faulty product.

13Cancellation and refunds

Cancellations, no-shows, early returns and refund timings are set out in full in our Cancellation & Refunds Policy, which forms part of these terms.

14Liability

Riding a motorcycle and trekking at altitude carry inherent risk. You take part voluntarily and accept those risks.

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited.

Subject to that, we are not liable for:

  • Loss or damage caused by your breach of these terms, or by your own act or omission
  • Personal belongings left in, on or with a vehicle or equipment
  • Indirect or consequential loss, including missed flights, connections or accommodation arising from a breakdown, road closure or itinerary change
  • Events outside our reasonable control, including weather, landslides, road and pass closures, strikes, civil disturbance, network or internet disruption, and acts of government

Where we are liable, our total liability for any booking is limited to the amount you paid us for that booking.

You agree to indemnify us against claims, fines and costs arising from your use of a vehicle or equipment in breach of these terms or of the law.

15Governing law

These terms are governed by the laws of India. The courts at Srinagar, Jammu & Kashmir have exclusive jurisdiction over any dispute arising from them.

Please raise any complaint with us first. Most things are resolved faster with a phone call than through any formal process.

16Changes to these terms

We may update these terms from time to time, and the date at the top shows when they last changed. The terms that apply to your booking are those in force on the day you made it.
